ORDINANCE NO. 9917 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED IN THE 3400 BLOCK OF HIXSON PIKE, BEING OFF THE SOUTHEAST LINE OF HIXSON PIKE AT LUPTON DRIVE FROM R-3 RESIDENTIAL ZONE AND R-4 SPECIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 3400 block of Hixson Pike, being off the southeast line of Hixson Pike at Lupton Drive. Part of an unplatted tract, being part of the property described in deed book X, volume 16, page 20, ROHC. Said part of tract begins on the southwest line of Lupton Drive some 315 feet southeast of the intersection of the southwest line of Lupton Drive with the southeast line of Hixson Pike, said point being 300 feet (if measured at a right angle) southeast of the southeast line of Hixson Pike, thence southeast some 549.87 feet with Lupton Drive, thence southwest 481.19 feet to a point in the northeast line of lot 10, Rivermont Place Unit No. 2, as shown by plat of record in plat book 21, page 82, ROHC, thence with the northeast line of said Rivermont Place subdivision, and said line extended, northwest 578.63 feet, thence southwest some 48 feet to a point 300 feet (if measured at a 0C right angle) southeast of the southeast line of Hixson Pike, thence northeast some 357 feet parallel to, and at all points 300 feet southeast of, the southeast line of Hixson Pike to the southwest line of Lupton Drive, the point of beginning. Tax Map No. 118K-A-46. from R-3 Residential Zone and R-4 Special Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Subject to dedication of right-of-way as required by the City Traffic Engineer. 2. Subject to a landscaped screen along the east line of this property as required by the proposed landscape ordinance. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
